Preservation Services Purchase Agreement & Terms and Conditions

By placing an order with Endless Florals (“Company,” “we,” “us,” or “our”), you are entering into a legally binding agreement for the creation of custom, handcrafted floral preservation artwork using natural botanical materials and resin.

Please read these Terms carefully. By completing your purchase, you confirm that you have read, understood, and agreed to the following provisions.

1. Nature of the Product – Commissioned Artwork

Endless Florals creates custom preservation pieces using real flowers and resin. Because flowers are organic and preservation is a handcrafted artistic process:

• Each piece is one-of-a-kind.

• Exact duplication of your original bouquet is not possible.

• Natural variations will occur.

• Artistic interpretation is part of the final result.

By purchasing our services, you acknowledge that you are commissioning original artwork, not a manufactured replica.

2. Artistic Interpretation

All designs are created using professional artistic judgment and discretion.

This includes but is not limited to:

• Selection of florals used in the piece

• Placement and composition

• Orientation and spacing

• Background and framing choices

• Resin layering and depth

• Color restoration adjustments

While we aim to honor the overall look and spirit of your bouquet and reference photos, exact replication is not guaranteed.

Dissatisfaction based solely on subjective artistic preference does not constitute a defect.

3. Natural Changes in Flowers

You understand and accept that flowers naturally change during the drying and preservation process.

These changes may include:

• Darkening, fading, or color shifts

• Whites turning ivory or cream

• Reds deepening to burgundy

• Appearance or enhancement of bruising

• Translucent spots

• Loss of shape in certain flowers

• Petal curling or shrinkage

Some flowers preserve better than others. These natural transformations are inherent to preservation and are not considered defects.

4. Resin Disclosure & Long-Term Aging

Resin is a chemical compound that naturally evolves over time.

Even under ideal display conditions:

• Resin may gradually yellow or develop a warm amber tone.

• Minor air bubbles may occur.

• Subtle internal movement of florals may happen during curing.

• Direct sunlight, heat, humidity, or environmental fluctuations may accelerate aging.

We use professional-grade resin with UV inhibitors; however, no resin product can remain permanently clear.

You acknowledge that:

• Resin yellowing is natural and unavoidable.

• Flowers may fade, brown, or soften with time.

• Petals may become fragile or brittle as they age.

• Small botanical particles may loosen or fall over time.

These changes are expected characteristics of preserved botanical artwork and are not defects.

Endless Florals does not guarantee permanent color retention, structural rigidity of petals, or indefinite resin clarity.

5. Shipping of Flowers to Endless Florals – Customer Responsibility

You are solely responsible for:

• Properly packaging your bouquet

• Arranging shipment or delivery

• Covering all shipping costs

• Including correct labeling within the shipment

All risk of loss, theft, or damage remains with you until your flowers are physically received by Endless Florals.

We are not responsible for:

• Carrier delays

• Weather exposure

• Lost shipments

• Misdelivery

• Transit damage

If flowers arrive damaged, wilted, moldy, or otherwise unworkable, we reserve the right to decline preservation.

If preservation cannot proceed due to condition upon arrival, your order will be canceled and refunded.

6. Condition Upon Arrival

Flowers will be preserved in the condition in which they are received.

We are not responsible for:

• Pre-existing bruising or breakage

• Wilted petals

• Mold or rot in pre-dried flowers

• Damage caused before arrival

If dried flowers are submitted, you accept the risk of structural weakness or mold development during preservation.

7. Design Limitations

Not all flowers or bouquet components may be used due to:

• Thickness constraints

• Structural fragility

• Size limitations of selected product

• Preservation compatibility

Ribbons, lace, charms, and personal items are not guaranteed to be included in the final piece.

If return of personal items is requested, you are responsible for return shipping fees. Unclaimed items may be discarded.

8. Quality Control & Pre-Shipment Inspection

Every finished piece undergoes a detailed quality control process before leaving our studio.

Prior to shipment:

• Each piece is inspected for structural integrity and finish quality.

• Resin surfaces are reviewed for proper curing.

• Frames and display components are checked for stability.

• The piece is cleaned and professionally prepared for packaging.

• Photographs are taken documenting the final condition of the artwork.

These photographs serve as verification that your piece left our studio in approved condition.

No item will be shipped if it does not meet our internal quality standards.

9. Shipping of Completed Artwork

All finished artwork is packaged using protective materials appropriate for fragile fine art.

A signature is required upon delivery unless waived in writing prior to shipment.

Once the package leaves our studio:

• Responsibility transfers to the shipping carrier.

• Endless Florals is not responsible for damage, theft, delay, or loss during transit.

• We do not guarantee carrier performance or delivery timelines.

If a piece arrives damaged:

1. You must notify us within 48 hours of delivery.

2. All original packaging materials must be retained.

3. Photographs of the exterior box, interior packaging, and damaged item must be provided.

Failure to retain original packaging may prevent carrier claims.

If a shipment is returned due to failed delivery attempts, incorrect address, or refusal of signature, additional shipping fees will apply.

10. Address Changes

It is your responsibility to update your shipping address before final shipment.

Endless Florals is not responsible for losses resulting from outdated or incorrect address information.

11. Order Cancellations & Refund Policy

Because each order reserves studio time and materials:

• Orders are non-refundable once preservation work has begun.

• If flowers arrive in an unworkable condition, your order will be canceled and refunded.

• If flowers are lost in transit, any refund will not exceed the amount paid to Endless Florals.

• We do not compensate for sentimental or retail value of flowers.

We reserve the right to cancel any order at our discretion if the client relationship is not conducive to a successful outcome.

12. Limitation of Liability

To the fullest extent permitted by law:

Our total liability for any claim related to your order shall not exceed the total amount paid for that order.

We are not liable for:

• Incidental or consequential damages

• Emotional distress

• Sentimental value loss

• Future aging of preserved materials

• Environmental damage after delivery

• Internal movement or natural structural shifts over time

13. No Time-Based Warranty

Due to the organic and chemical nature of preserved flowers and resin:

Endless Florals does not provide a time-based warranty or longevity guarantee.

Natural aging, fading, yellowing, structural changes, and material evolution are expected characteristics of preserved botanical artwork.

14. Marketing & Photography Rights

Endless Florals retains the irrevocable right to photograph and document:

• Fresh bouquets

• The preservation process

• Final artwork

These images may be used for:

• Website display

• Social media

• Advertising

• Portfolio and promotional purposes

By proceeding with our services, you grant Endless Florals perpetual, royalty-free rights to use such imagery without additional compensation or approval.

15. Turnaround Time

Turnaround estimates are provided as general guidance only.

Completion times may vary due to:

• Flower condition

• Studio volume

• Material sourcing

• Environmental curing conditions

• Unforeseen circumstances

Estimated timelines are not guaranteed deadlines.

16. Product Handling & Safety

Preserved floral artwork is fragile and should be handled with care.

Endless Florals is not liable for injuries or damages resulting from improper handling, misuse, dropping, or environmental exposure after delivery.

17. Use of Excess Florals & Studio Inventory

Due to the nature of the preservation process, not all flowers or botanical materials provided within a bouquet may be used in the final artwork.

By submitting your flowers to Endless Florals, you acknowledge and agree that:

• Endless Florals retains full discretion over which flowers are selected and incorporated into your preservation piece.
• Any excess or unused flowers will not be returned unless explicitly requested and agreed to in writing prior to shipment.
• All unused floral materials become the property of Endless Florals upon receipt.

Endless Florals reserves the right, at its sole discretion, to:

• Dispose of unused flowers, or
• Retain and incorporate such materials into studio inventory for use in future artistic work, recreations, or other preservation projects.

By proceeding with our services, you expressly waive and relinquish any ownership interest, claim, or right to any unused floral materials not included in your final preserved piece.

18. Governing Law

These Terms shall be governed by the laws of the state in which Endless Florals operates. Any disputes shall be resolved in accordance with applicable state law.
