By proceeding with your purchase, you are entering into a contract with Endless Florals for the creation of a unique, handcrafted preservation product utilizing a vegetative medium. Due to the nature of this process, each product will be distinct and may vary from the original fresh floral arrangement.

The terms governing your purchase are detailed in this Purchase Agreement, outlined below. By completing your purchase, you confirm that you have read, understood, and agreed to these terms. Additionally, this Purchase Agreement incorporates by reference our Terms of Service, which apply to your use of our website and services.

As a condition of purchase, you are required to confirm that you have read and accepted these Terms and Conditions. By doing so, you acknowledge your understanding and agreement to all applicable terms, including those outlined in our Terms of Service, and the additional provisions stated below:

Terms of Service

• You acknowledge and agree that you are solely responsible for arranging and covering all costs associated with the shipping or delivery of your bouquet to Endless Florals. Endless Florals assumes no responsibility for any damage, loss, or delays that may occur during transit. Furthermore, you waive any claims or remedies against Endless Florals for bouquets that are lost, delayed, or damaged before they arrive at our premises.

• You acknowledge and agree that your bouquet will be preserved and worked with in the condition in which it is received. Endless Florals is not responsible for any pre-existing damage or condition of the flowers upon arrival.

• You understand and acknowledge that the drying, pressing, and preservation process naturally alters flowers, resulting in changes such as color variations, the appearance or enhancement of bruises, translucent spots, and the formation of some bubbles. Additionally, flowers may shift slightly within the resin during the preservation process. These changes are inherent to the preservation method and are not considered defects.

• You acknowledge and agree that if your bouquet is lost or damaged during shipping or delivery, Endless Florals will only provide a refund up to the amount you paid to Endless Florals. We are not responsible for the monetary value of the bouquet, individual flowers, or any incidental or consequential losses or damages.

• You acknowledge and agree that Endless Florals is not responsible for flowers that are lost, damaged, or stolen during transit. All risk associated with shipping remains your responsibility.

• You acknowledge and agree that Endless Florals will only preserve the amount of flowers they feel are required for the selected piece and design of your products.
  
  
• You acknowledge and agree that Endless Florals, at its sole discretion, may issue a refund of up to the total amount you paid for your order in the event of dissatisfaction or damage to your bouquet or flowers. However, you waive any right to claim damages or seek compensation beyond the amount you paid, including any additional claims against Endless Florals.

• You acknowledge and agree that if your bouquet arrives in a condition deemed unworkable by Endless Florals, your order will be canceled, and you will receive a refund.

• You acknowledge and agree that if you send flowers that have been dried in advance, Endless Florals is not responsible for any mold, rot, or hairs that may be visible or develop during the preservation process.

• You acknowledge that Endless Florals reserves the right to decline the preservation of any flowers that arrive in a damaged or wilted condition, where our designer deems the preservation process unlikely to succeed. In such cases, we will not be held responsible for returning the damaged or wilted flowers. However, for an additional fee, Endless Florals may offer to source replacement flowers that most closely resemble your original arrangement.

• You acknowledge that resin may naturally yellow or amber over time. Even under optimal conditions, this is a standard process, and Endless Florals assumes no liability for such changes. Additionally, flowers preserved in displays may change color or brown over time, and Endless Florals is not responsible for these natural alterations that occur as part of the preservation process.

• You acknowledge and agree thatEndless Florals retains the right to photograph all products created through our services and use these images on our website, social media platforms, and in advertisements without limitation. Additionally, any photos provided by you to Endless Florals will be considered authorized for posting on our social media channels.

• You acknowledge and agree that not all flowers in your bouquet may be used for preservation due to factors such as thickness, flower condition, or limited space in the design mock-up and or frame.

• You acknowledge and agree that ribbons, pendants, and lace may not be included in the final preserved piece. If such items are shipped with the flowers, you are responsible for covering the cost of their return. If not returned, these items will be discarded.

• You acknowledge and agree that if your shipping address changes before your product is complete and is shipped, it is your responsibility to update the address through your account page or by contacting us. Endless Florals is not responsible for address changes not made in time.

• Endless Florals retains the right to cancel any order at its sole discretion if, in its professional judgment, the client relationship is not conducive to a successful or satisfactory outcome.

• You acknowledge and understand that the turnaround time for your order, in relation to your event date, may be subject to change due to factors that could delay Endless Florals delicate preservation process. This includes, but is not limited to, the need for a flower reorder or other unforeseen circumstances.

• Endless Florals shall not be held responsible or liable for any injuries or damages sustained in connection with the use or handling of the product.

• You acknowledge that it is your responsibility to ensure that your flowers and all contents are properly labeled within the shipment box before sending. Should labeling be omitted, or filled out incorrectly, you understand that any unmarked items may be discarded.

• You acknowledge and agree that a signature will be required upon delivery of your final product due to its sentimental value and cost, ensuring it reaches the correct recipient. If you choose to waive this signature requirement, you understand that it must be done by emailing Endless Florals prior to the shipment of your order.

• You acknowledge and agree that your order will not be shipped until all outstanding balances have been paid in full.
